This website is provided and maintained by Child in Mind (“Child in Mind”). BY ACCESSING, AND MAKING USE OF THIS WEBSITE, YOU AGREE, ON YOUR OWN BEHALF AND ON BEHALF OF ANY INDIVIDUAL OR ENTITY ON WHOSE BEHALF YOU MAY BE ACTING, THAT YOU HAVE READ AND AGREE TO BE BOUND BY ALL THE TERMS AND CONDITIONS. If you do not wish to be bound by the Terms of Use, you should not use this website.

Changes to terms and conditions

Child in Mind may add to or remove, modify or otherwise change any part of the Terms and Conditions at any time. Changes will be effective when the changed Terms and Conditions are posted on this website. You should check the Terms and Conditions frequently for changes. If any change to the Terms and Conditions is not acceptable to you, you should discontinue your use of this website immediately. Your continued use of this website after changes to the Terms and Conditions are posted thereon will constitute acceptance of the changes.


PROTECTION OF PERSONAL INFORMATION

Online bookings

This website allows you to complete online bookings for appointments with Child in Mind.  This process involves creating a password secured account, linked to your email address, in which you will be able to create appointments and upload personal and medical information all within the booking software (the “Booking Engine”).

Collection of Personal Information

When you use the Booking Engine to book an appointment with Child in Mind, certain information is collected on behalf of Child in Mind to set up your user account, provide you with access to the system, confirm your identity, schedule your appointment and collect relevant medical information (“Personal Information”).  

This Personal Information may include:

  • your identification and contact information (name, health care number, gender, address, date of birth, email, etc);

  • your health information (symptoms, diagnosis, medical history, test results, reports, messages and treatment, prescriptions, etc);

  • information regarding your past medical treatment and your care providers; and

  • information regarding professional services administered by other providers, including notes, discussions, advice, opinions or diagnoses.

Limits on Collection

Through the Booking Engine, Child in Mind only collects Personal Information that is required to facilitate the provision of care and to communicate with you. Child in Mind does not collect any other Personal Information, or allow Personal Information to be used for other purposes without your express (written or verbal) consent, except where compelled to do so by law, such as complying with a subpoena or court order.

Authority and Consent

Child in Mind has the requisite authority from the applicable governing bodies, legislation and associated regulations to collect, store, use and disclose this Personal Information as set out in these terms and conditions.  By accessing and making use of the Booking Engine on this website, you are providing Child in Mind with your express consent to collect, store, use and disclose your Personal Information as set out in these terms and conditions.

To the extent that you have a substitute decision maker, we may require that the individual validate his or her authority to act on your behalf before accepting information, direction or consent from that individual.

Protecting your Personal Information

Child in Mind recognizes and respects your need for privacy and security while visiting this website and providing Personal Information to book appointments.  The Booking Engine employed on this site wholly based in Canada, assures the privacy of all client information and deploys software using industry-standard firewalls and best practices of the information security industry.

At Child in Mind we educate and train our staff on the importance of protecting Personal Information and ensure that access is provided only on a “need-to-know” basis. We use roles-based access to ensure that only those who are authorized to access your Personal Information can access it.

Electronic Messages

By using the Booking Engine, you expressly consent to receiving electronic messages (emails, text messages, instant messages or any similar form of message) from Child in Mind which messages shall provide information related to appointments with and information from Child in Mind.  You may contact Child in Mind at (email) in order to cancel your consent to receive electronic messages at any time.

No sharing

Your password protected access to the Booking Engine cannot be shared with anyone. You will maintain a single user account represented by your email address.  You will only use the Booking Engine under this single identity and will not share your password with any other person or permit another person to interact with the Booking Engine using your account information or password, other than in the case of caregivers that have proper authority.

Your Security Responsibilities

You are solely responsible for ensuring the security and confidentiality of your password for the Booking Engine. You will prevent unauthorized access to or use of the Booking Engine, and notify Child in Mind promptly of any such unauthorized use.  You are responsible for the use of the Booking Engine by you or any other person using your password.  It is your responsibility to ensure that your account password is of sufficient strength and is changed regularly to prevent unauthorized access.  You shall ensure that any computer used by you to access the Booking Engine is secure and has up-to-date antivirus and security software.

You will not use your access to the  Booking Engine to: (a) access, harvest, collect, modify, copy, gather or assemble information or data regarding other Child in Mind patients without their consent; or (b) knowingly interfere with or disrupt the integrity or performance of the  Booking Engine or the data contained therein.

You are solely responsible for the data that you upload to the Booking Engine and you will not provide, post or transmit any data, information, content or material that: (a) infringes, misappropriates or violates any intellectual property rights, publicity/privacy rights or other rights of any third party, or any law or regulation; (b) use the Booking Engine in any way that is unlawful, libellous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable; (c) use the Booking Engine in any way that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, provincial, national or international law;  (d) contains any viruses or programming routines intended to damage, surreptitiously intercept or expropriate any system, data or personal information; or (e) use the Booking Engine in any way that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity.

Recourse on your breach

In addition to any other right or remedy that Child in Mind may have pursuant to the terms and conditions, any agreement or at law, Child in Mind may terminate or suspend (partially or completely) your access and use of the Booking Engine through this website, and for the purpose of Child in Mind’s services, without prior notice for any reason, but Child in Mind will confirm such termination or suspension by subsequent notice to you.

Uploaded Content

Child in Mind takes no responsibility and assumes no liability for any content posted, stored or uploaded by you, on your own behalf or on behalf of any party you are duly authorized to represent, or any other Booking Engine user, in or to the Booking Engine, or for any loss or damage arising therefrom.

You retain all ownership in and to the content you upload to the Booking Engine, including your Personal Information. You grant to Child in Mind all necessary licenses in and to your data as necessary for Child in Mind to provide the medical services to you or the party you are duly authorized to represent.

Child in Mind will not disclose your personal information to any third party without your consent, unless such disclosure is required by law.

Notwithstanding any of the other terms and conditions, Child in Mind maintains sole ownership to the aggregation of any data derived from Personal Information that you or other users have uploaded to the Booking Engine but containing no personal identifier (“Anonymized Data”),  and may use Anonymized Data at the sole discretion of Child in Mind and may transfer, convey, sell, manipulate and otherwise exploit such Anonymized Data.

Termination of treatment

Should your treatment with Child in Mind cease for any reason, (a) the license granted to Child in Mind in respect of your data uploaded on the Booking Engine survives for so long as Child in Mind is required by law to retain such information; and (c) Child in Mind will be entitled to retain and use the Anonymized Data in accordance with the terms of this Agreement, subject always to the provincial and federal laws of Canada.

Ownership and usage

Child in Mind will from time to time post content to this website. All rights, title and interest in original writing or images are held or for the benefit of Child in Mind unless otherwise expressly indicated.  To use any posted images or text prior approval must be obtained directly from a representative of Child in Mind, which can be requested by calling or emailing , details of the intended use along with your contact information should be provided with the correspondence. Any use of website content without prior approval, or outside the approval obtained, is a direct infringement on the rights and interests of Child in Mind and is punishable by law.  Nothing in these terms and conditions will act as consent to use website content or as a waiver or restriction on Child in Mind’s legal rights to pursue an infringing party to the full extent of the law.
